The petitioner apprehends his arrest in Chiraiya P.S. Case No.164 of 2018 registered under Sections 20, 22, 23 and 24 of the N.D.P.S. Act.

Learned counsel for the petitioner submits that the petitioner was not arrested on the spot. Nothing has been recovered from the conscious possession of the petitioner. Only 50 grams of Ganza is alleged to have recovered from the grocery shop of the petitioner.

It appears that seeing the police officer, the petitioner fled away. Police got information that the petitioner was selling Ganza from his grocery shop and on such raid was conducted at

Patna High Court Cr.Misc. No.40012 of 2018 (2) dt.11-07-2018 2/2 the shop of the petitioner and 50 grams of Ganza was recovered. Taking into consideration the fact that the petitioner is alleged to have selling Ganza from his grocery shop and on search 50 grams of Ganza was recovered from his grocery shop, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
