This application has been filed for quashing the order of cognizance dated 09.12.2015 passed in Brahampur P.S. Case No. 190 of 2015 (T.R. No. 2313 of 2016) by the learned Sub Divisional Judicial Magistrate, East, Muzaffarpur for the offence under Section 7 of the Essential Commodities Act.

The allegation against the petitioner is of black marketing of food grains of F.C.I.

This Court does not find any error in the order of cognizance passed by the court below. Accordingly, this

Patna High Court Cr.Misc. No.21920 of 2016 (3) dt.22-10-2016 2/2 application is dismissed. However, liberty is given to the petitioner to raise all the points at the appropriate stage of the trial.
