2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 30(a) and 45 of the Bihar Prohibition and Excise Act.
3. As per the prosecution case, 39 litres of foreign liquor has been recovered from the house of the petitioner.
4. Learned counsel for the petitioner submits that petitioner has clean antecedent and has falsely been implicated in the present case. He further submits that nothing has been recovered from the conscious possession of the petitioner, rather recovery has been made from the house in question which is a joint property.

5. Learned APP for the State opposes the bail prayer of the petitioner and submits that recovery has been made from the house of the petitioner.
6. Considering the aforesaid facts and circumstances and also the fact that recovery has been made from the house of the petitioner, the prayer for anticipatory bail of the petitioner is rejected.
