The petitioners, namely, Pankaj, Md. Shamsher Khan, Md. Anwar Hassan and Sajid, apprehend their arrest in Barachatti P.S. Case No. 35/2016 registered under Sections 467, 468, 471, 420, 387 and 120(B) of the Indian Penal Code. The police, after information, went to the house of Guddu Khan @ Sadab Khan and found a truck parked there. The truck was seized and seizure list was prepared. Forged documents were recovered from the house of Guddu Khan @ Sadab Khan. It is submitted that the name of the petitioner figured in the confessional statement of Guddu Khan @ Sadab Khan who disclosed that the petitioner is also involved in committing theft of
Patna High Court Cr.Misc. No.21884 of 2016 (4) dt.16-08-2016 2/2 the truck. It is also submitted that a similarly situated co-accused Kamal Khan has already been granted anticipatory bail vide order dated 03.05.2016 passed in Cr. Misc. No. 17653/2016 by a coordinate bench of this Court. The case of the petitioners stands on the same footing and the petitioners have got no criminal antecedents.
Considering the facts aforesaid and the fact that similarly situated co-accused has already been granted anticipatory bail, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Sherghati, District Gaya in Barachatti P.S. Case No. 35/2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
