This is an application for bail in connection with Jalalpur P.S.Case No. 47 of 2017 registered for the offences punishable under Sections 302 and 201/34 of the Indian Penal Code. Allegation against the petitioner is that he along with other accused persons has taken the deceased and later on his dead body was recovered from pond and it is alleged that they have caused death of deceased.
Submission of learned counsel for the petitioner is that occurrence has taken place in broad day light but in spite of that there is no eye-witness to the occurrence and he is in custody for three months.

Patna High Court Cr.Misc. No.50678 of 2017 (4) dt.15-11-2017 2/2 Having heard both sides and in the facts and circumstances, I am not inclined to grant bail to the petitioner at this stage.
However, once charge has been framed in this case, learned trial court shall release the petitioner on bail to its own satisfaction on the condition that he will co-operate in trial. With the above observation, this application is disposed of.
