Let the defect (s), as pointed out by the office, be removed within a period of four weeks from the date of resumption of physical filing and physical removal of defect. In the present case, the petitioner seeks bail in connection with Daraunda P.S. Case No. 364 of 2021 registered for the alleged offences under Sections 341, 323, 324, 307, 380, 504/34 of the Indian Penal Code.

The allegation against the petitioner is that he hit on the head of the husband of the informant causing injury on his head and also caused injury in the eyes of the husband of the informant.

No.18096 of 2022(2) dt.27-06-2022 2/3 The learned counsel for the petitioner submits that the informant is the wife of the brother of the petitioner and a minor altercation took place between the parties. There is case and counter case for the same occurrence and the case of the petitioner is earlier in time. The injuries are only tenderness and swelling on the head but it is stated to be grievous. The other injury is merely bruise below knee, but it is stated to be simple in nature. The dispute over property is admitted and the petitioner is in custody since 16.02.2022.

The learned counsel for the informant opposes the submission made by the learned counsel for the petitioner. He submits that the petitioner was involved in such occurrence earlier also.

Having regard to the submission made hereinabove and considering the fact that there is a case and counter case in the background of some property dispute and further considering the nature of injury and period of custody of the petitioner, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Siwan/court concerned in connection with Daraunda P.S. Case No. 364 of

(i) One of the bailors will be a close relative of the petitioner.

(ii) The petitioner will remain present on each and every date fixed by the court below.
