ANJANA MISHRA ORAL ORDER 19-08-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Sections 364/34 of the Indian Penal Code and Section 302/201 of the Indian Penal Code were subsequently added.

Diary in this case was called for earlier which has since been received.

After hearing learned counsel for the petitioner and learned counsel for the State and on perusal of the case diary, it appears that the name of the petitioner surfaced in the confessional statement made before the police by a co-accused which has no evidentiary value.

In view of the aforementioned facts and circumstances and

Patna High Court Cr.Misc. No.23756 of 2016 (4) dt.19-08-2016 P2/2 also the fact that the petitioner has one other criminal antecedent, let the petitioner, in the event of his arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Danapur, Patna in connection with Dulhin Bazar P.S. Case No. 207/2015, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
