JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-07-2018 Earlier prayer for bail of the petitioner was rejected by this Court vide order dated 25.7.2017 passed in Cr.Misc.No. 30360 of 2017 with an observation to conclude the trial within a period of nine months.

Submission of learned counsel for the petitioner is that though there is allegation against the petitioner that he assaulted by spade but the same falsifies from the fact that allegation of assault is against son of the petitioner and till date trial has not been concluded and petitioner is in custody for two years. Heard learned APP also.

Having heard both sides and in the facts and circumstances, as stated above, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees

No.41446 of 2018 (2) dt.11-07-2018 2/2 twenty five thousand) with two sureties of the like amount each to the satisfaction of Additional District and Sessions Judge-III, Araria, in connection with Sessions Trial No. 553 of 2016, arising out of Sikty (Bardaha) P.S.Case No. 86 of 2016, subject to the conditions that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned and petitioner has to co-operate in disposal of trial and appear before the trial court as and when required, otherwise his bail bond shall be cancelled.
