====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR JHA ORAL ORDER 16-05-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. In the present case, the petitioner seeks bail in connection with Naya Gaon P.S. Case No. 213 of 2023, registered for the offences under Sections 392 of the Indian Penal Code.
3. As per the prosecution case, the informant was working as Branch Manager of a non-banking financial company and had been carrying Rs.8,38,800/-, the amount which was collected by the informant. The informant and his associate were threatened by two miscreants and they snatched the bag containing Rs.8,38,800/- on gun point and both the miscreants fled away on a motorcycle on which already a youth
Patna High Court CR. MISC. No.17909 of 2025(3) dt.16-05-2025 2/3 was sitting. The name of the petitioner transpired during investigation for being involved in the said occurrence.
4. Learned counsel appearing on behalf of the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. The petitioner was apprehended in some other case and his confessional statement was recorded and he has been implicated in this case. No Test Identification Parade was done and there is no recovery of any looted money or any incriminating article from the petitioner. Except for the confessional statement of this petitioner, there is no material to show the involvement of the petitioner in the offence as alleged. Investigation is complete in this case and charge sheet has been submitted. The petitioner is in custody since 27.09.2024. The petitioner has antecedent of eight cases and he is on bail in all the cases.
5. Learned A.P.P. appearing for the State opposes the submission made on behalf of the petitioner. Learned A.P.P. submits that on gun point, the petitioner and other co-accused person, snatched the bag of the informant.
6. Having regard to the fact and circumstances and submission made on behalf of the parties and considering the absence of materials to connect the petitioner with the offence
Patna High Court CR. MISC. No.17909 of 2025(3) dt.16-05-2025 3/3 as alleged and further considering his period of custody and submission of charge sheet, the petitioner is directed to be released on bail, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of learned J.M.F.C., Saran at Chapra/concerned court, in connection with Naya Gaon P.S. Case No. 213 of 2023, subject to the condition laid down under Section 480(3) of the B.N.S.S. and other following conditions: (i) One of the bailors will be a close relative of the petitioner.
(ii) The petitioner will remain present on each and every date fixed by the court below, if so required by the learned trial court.
(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
