JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 16-07-2015 Heard learned counsel for petitioners and learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Kudra P.S. Case No. 131 of 2015 registered for the offence under Sections-409, 420 of the Indian Penal Code. Petitioners happen to be rice millers and accusation against them is that they failed to supply the rice and misappropriated huge government money.
The agreement executed between the parties reveals that there was a clause that in failure to supply of rice, the corporation may institute a certificate case.
Patna High Court Cr.Misc. No.26472 of 2015 (2) dt.16-07-2015 2/2 Moreover, it is informed on behalf of the petitioners that several cases of similar nature were registered against different persons and several persons are enjoying the privilege of anticipatory bail.
Accordingly, in the event of their arrest or surrender within four weeks from the date of receipt/production of copy of order in the court below, let the petitioners named above, be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Kudra P.S. Case No. 131 of 2015 to the satisfaction of Chief Judicial Magistrate, Kaimur at Bhabua subject to conditions as laid down u/S 438(2) of the Cr. P.C.
