ANJANA MISHRA ORAL ORDER 09-11-2017 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 27.07.2017 in connection with Phulwarisharif P.S. Case No.451 of 2017 registered for the offence under Sections 461, 379 and 411 of the Indian Penal Code.
It is submitted by the learned counsel for the petitioner that the allegation against the petitioner is wholly frivolous as 1000 currency notes were being taken back by the R.B.I. after demonetization after November, 2016 and the same was not in rotation. Learned counsel for the petitioner further submits that the petitioner was taken into custody on pure suspicion and there is a serious cloud on the prosecution story.

Priya Shekhar, Judicial Magistrate, 1st Class, Patna, in connection with Phulwarisharif P.S. Case No.451 of 2017.
