JUSTICE SUDHIR SINGH ORAL ORDER 22-09-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Section 366 of the Indian Penal Code. Allegation against the petitioner is that he took wife of informant with him for some labour work and thereafter she is traceless.

It has been submitted on behalf of the petitioner that the present case has been instituted on the basis of written statement of the informant dated 13.2.2014 where he had raised suspicion against the petitioner in respect of abduction of his wife. Subsequently, again on 6.3.2014 he made a petition (Annexure-2) to the Superintendent of Police, Buxar, where he stated that his wife had left house on 4.2.2015 with other person. Whereafter he has made a petition (Annexure-3) in the court below in which he has stated that the present case has been compromised. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

No.26081 of 2015 (3) dt.22-09-2015 2 / 2 Considering the aforesaid facts, let the above named petitioner, in the event of arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar, in connection with Sikroul P.S. Case no.25 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
