JUSTICE DINESH KUMAR SINGH ORAL ORDER 02-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 272, 273 and 290 of the Indian Penal Code and Section 47(a) of the Excise Act. It is alleged that from the house of the petitioner, 33 bottles of beer each containing 650 ML were recovered. It is submitted by learned counsel for the petitioner that even assuming the accusation, no offence under Excise Act is made out.

The aforesaid facts constitute good ground for consideration of prayer for regular bail.

Let the learned court below consider the prayer for regular bail of the petitioner if he surrenders within a period of six weeks in connection with Deepnagar P.S. Case No. 61 of 2015

Patna High Court Cr.Misc. No.26067 of 2015 (2) dt.02-07-2015 2/2 pending in the court of learned SDJM, Nalanda. Accordingly, the application is disposed of.
