====================================================== CORAM: HONOURABLE MR. JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 09-03-2022 The learned counsel for the petitioners is directed to remove all the defects pointed out by the Stamp Reporter within one month.

Heard learned counsel for the petitioners as well as learned APP for the State assisted by learned counsel for the informant.

The petitioners apprehend their arrest for the offences alleged under Sections 341, 323, 308, 504 and 34 of the Indian Penal Code, registered in connection with Bagaha P.S. Case No.535 of 2018 (Trial No.1925 of 2020).

As per allegation, the accused persons abused in filthy

Patna High Court CR. MISC. No.27174 of 2021(2) dt.09-03-2022 2/3 words and also attacked the members of informant's side. Coaccused Wakil Thakur as per FIR has threatened to oust them from the village. There is allegation of snatching golden chain is against petitioner no.2.

The learned counsel for the petitioners has submitted that the dispute arose due to the fact that the goat of co-accused Wakil Thakur has destroyed the paddy crop of the informant's side. He has submitted further that there is case and counter case and petitioners have no antecedent.

On the other hand, learned counsel for the informant has submitted that the informant's side was threatened to be ousted from the village.

Considering the above-mentioned facts and circumstances as well as the clean antecedent of the petitioners, let the petitioners above named, in the event of his arrest or surrender within three weeks from the date of communication of this order be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, West Champaran, Bagaha in connection with Bagaha P.S. Case No.535 of 2018 (Trial No.1925 of 2020), subject to the conditions as laid down under Section 438(2) of the Cr.P.C.

Patna High Court CR. MISC. No.27174 of 2021(2) dt.09-03-2022 3/3 Office shall ensure that all the defects are removed by the petitioners within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
