JUSTICE DINESH KUMAR SINGH ORAL ORDER 21-07-2015 The petitioner apprehends arrest in a case registered under sections 420, 406, 467, 468, 471 and 120(B) of the Indian Penal Code and section 3(i)(x) of SC/St(POA) Act. It is alleged that the complainant- informant purchased certain piece of land from petitioner no.2 vide the registered sale deed 21-8-2007. On 11-12-2013 one Ramdeo Yadav was cutting crop from the purchased land of the informant, which was objected, and it was found that petitioner no.2 executed the sale deed for more than an area he was entitled to transfer. It is further alleged that on protest being made the accused abused informant by calling caste name.
It is submitted that the petitioners were cutting crops on their own land and under bonafide mistake the informant raised
Patna High Court Cr.Misc. No.27226 of 2015 (2) dt.21-07-2015 2/2 objection. A compromise petition has been filed before the court below, which has been brought on record as Annexure-2. Considering the accusation in the background of land dispute between the parties, let the above named petitioners be released on anticipatory bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Saharsa, in connection with G.R. No 3234/14 arising out of Saharsa SC/ST P.S.Case No. 46/14, subject to the conditions as laid down under section 438(2) Cr.P.C.
