JUSTICE DINESH KUMAR SINGH ORAL ORDER 24-05-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147, 148, 341, 323, 427, 504, 380, 354 of the Indian Penal Code and section 3(1) (x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.
Prosecution case is that the accused persons including the petitioner entered into the house of the informant, made assault and abused by calling caste name. The accused persons also took away the household articles of the informant. It is submitted by learned counsel for the petitioner that the present accusation has been levelled in the background of 107 Cr.P.C. proceeding, initiated for a dispute with regard to a piece of land, between the parties. Patna High Court Cr.Misc. No.23305 of 2016 (2) dt.24-05-2016 2/2 filed Case No.332/2012-13 before the LRDC, Biroul, Darbhanga wherein the LRDC passed order in favour of the husband of the petitioner.
Considering the aforesaid facts and the petitioner being a lady, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Biroul, Darbhanga, in connection with SC/ST P.S. Case No.25/2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
