Mr. Ram Bilash Roy Raman For the Informant :

Mr. Ajay Kumar Singh ====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 19-04-2024 Heard learned counsel for the parties.

2. As both these bail applications have cropped up from the same police station case number, hence, with consent of parties, they are being heard together and disposed of by this common order.

3. The petitioners seek bail in connection with Chakia P.S. Case No.282 of 2023, registered for the offence punishable under

Patna High Court CR. MISC. No.18869 of 2024(3) dt.19-04-2024 2/2 Sections 302, 120B of the Indian Penal Code and 27 of Arms Act.

4. The allegation against the petitioners is that they, along with other co-accused persons murdered the brother of the informant by stabbing with knife and shooting from fire arms.

5. It is submitted by learned counsel for the petitioners that petitioners are quite innocent and have committed no offence. They have been falsely implicated in this case. No such occurrence, in the manner as alleged, has ever taken place. Petitioners have no criminal antecedent. Petitioners are rotting in jail since 11.01.2023.

6. Learned APP for the State as well as learned counsel for the informant vehemently opposed the prayer for bail.

7. Having regard to the facts and circumstances of the case as well as considering the nature of offence, I am not inclined to enlarge the petitioners on bail. The prayer for grant of bail on their behalf is hereby rejected.

8. Accordingly, these applications are dismissed.

9. However, petitioners are at liberty to renew their prayer for bail after framing of charge.
