2. Petitioners are apprehending their arrest in connection with a case registered for the offences under Sections 342, 323, 354, 324, 504, 506/34 of the Penal Code and Sections 3(i)(x) of the SC/ST (Prevention of Atrocities) Act.
3. It is submitted on behalf of the petitioners that they are not only said to have misbehaved, abused the daughter, daughter-in-law of the informant but also the informant. It is further submitted that informant has neither daughter nor daughter-in-law, which fact must have been found out by the Investigating Officer during investigation.
4. Let petitioners surrender in the court below within
Patna High Court Cr.Misc. No.35023 of 2014 (2) dt.20-02-2015 2/2 a period of four weeks from the date of receipt/production of a copy of this order in the court below whereafter the court below with reference to the materials collected in the case diary shall examine the aforesaid submission and if found true petitioners, named above, be released on bail on furnishing bail bonds of Rs. 5,000/-(Rs. Five Thousand Only) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Danapur, in connection with Bihta P.S. Case No. 82/14, subject to the conditions laid down under Section 438(2) Cr.P.C. So long the case diary is not brought on record and the matter considered in the light of the materials contained therein, no coercive steps will be taken against the petitioners.
