JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 22-10-2021 Heard learned counsel for the petitioners and learned APP for the State through video conferencing. Learned counsel for the petitioners is directed to remove all the defects pointed out by the Stamp Reporter within one months.

Learned counsel for the petitioners has submitted that during pendency of this anticipatory bail petition, petitioner No. 2 (Dharmendra Sah) and petitioner No. 3 (Upendra Sah) were arrested as such he wants to withdraw the anticipatory bail application as against them.

As prayed by learned counsel for the petitioners, the anticipatory bail petition as against petitioner No. 2 and 3 is

So far as the petitioner No. 1, Ram Dayal Sah @ Ram Dayal Prasad is concerned, the allegation against him is that of damaging motorcycle of the informant's side.

Learned counsel for the petitioners has submitted that petitioner No.1 is innocent and has committed no offence. The allegation against the petitioner No. 1 is only for damaging the motorcycle and the allegation of assaulting the members of informant party is not against the petitioner No. 1 rather it is attributed to other accused persons.

Considering the aforementioned facts and circumstances, let the petitioner No. 1 in the event of his arrest or surrender within four weeks before the court below be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Siwan in connection with Daraunda P.S. Case No. 336 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C.

Office shall ensure that all defects are removed and compliance with the notices of this Court are made by the petitioner within the stipulated time provided in para 1 hereinabove, failing which the matter shall be brought to the notice of this Court. (Nawneet Kumar Pandey , J) SONALI/- U T
