JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 08-04-2015 Heard learned counsel for the petitioner and learned counsel representing the State.

Petitioner apprehends his arrest in connection with Mufassil P.S. Case No. 88 of 2012 registered for the offences punishable under Sections 376/34 of the Indian Penal Code. Allegedly, FIR named accused and one another committed rape upon the dumb niece of the informant. Submission is of false implication, the petitioner is co-villager but after lapse of six months in second supervision note of Dy.S.P. name of the petitioner has been dragged and except that there is nothing against the petitioner, and as such, the petitioner deserves sympathetic consideration to which the learned

Patna High Court Cr.Misc. No.33800 of 2014 (3) dt.08-04-2015 APP fairly submits that besides the supervision note in the entire case diary there is nothing against the petitioner. In the facts and circumstances stated above and as name of the petitioner has come after six months in the second supervision note of the Dy.S.P., the petitioner above named, in case of his surrender or arrest within two months from the date of receipt/production of a copy of this order, shall be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Samastipur in connection with Mufassil P.S. Case No. 88 of 2012, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
