Petitioner apprehends his arrest in connection with Aurangabad Mufassil P. S. case no. 161/2013 registered under sections 307, 380 and other allied sections of the Indian Penal Code and 27 of the Arms Act.
Petitioner is named in the first information report but no specific overt-act has been attributed against him. The contention on behalf of the petitioner is that petitioner happens to be relative of the informant and other accused and moreover, having more or less similar allegation one co-accused Ram Yash Rai, who happens to be full brother of the petitioner, has already been granted privilege of anticipatory bail by this court vide order dated 23.7.2015 passed in Cr. Misc. no. 28495/2015. Accordingly, this anticipatory bail petition is allowed and it is ordered that in the event of arrest/ surrender within four weeks from
Patna High Court Cr.Misc. No.25942 of 2015 (2) dt.28-07-2015 the date of receipt of this order to the concerned court, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Aurangabad in Aurangabad Mufassil P. S. case no. 161/2013 subject to condition as laid down under section 438(2) of the Cr.P.C.
