Petitioner apprehends arrest in a case registered for the offence punishable under Section 30a of the Bihar Prohibition and Excise Act.

Police recovered 69.48 liters of foreign liquor from the house of co-accused Ravindra Singh. Police arrested him along with other co-accused who named the petitioner as their accomplice. Petitioner somehow managed to flee away from the spot.

Learned counsel appearing for the petitioner submits that the petitioner has falsely been implicated in this case. Petitioner has got no criminal antecedent. Nothing has been recovered from his conscious possession. He is no way concerned with the recovery. The mandatory provision of law for search and seizure given under section 100 Cr.P.C. has not

Patna High Court CR. MISC. No.17991 of 2020(2) dt.12-06-2020 2/2 been followed. Petitioner's name has come in this case on the confessional statement of co-accused.

Considering the facts of the case, let the petitioner, above named, in the event of surrender before the Court below within six weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge 4, Bhojpur at Arrah in Tarari Police Station Case No. 226/2019, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
