JUSTICE ASHUTOSH KUMAR ORAL ORDER 10-07-2018 This application for grant of regular bail arises out of Kanti P.S. Case No. 129 of 2018, dated 21.03.2018, instituted for the offences under Sections 401, 413 and 414 of the Indian Penal Code and Section 25(1-b)a/26 of the Arms Act.
The petitioner is alleged to have been caught while fleeing away and in the process, he injured himself. Learned counsel for the petitioner has submitted that nothing has been recovered from his possession and he has falsely been made accused in the
Patna High Court Cr.Misc. No.40065 of 2018 (2) dt.10-07-2018 2/2 present case because of the machination of the local police. In fact, the petitioner was made accused in one case earlier, in which he is on bail, but after the institution of the present case, he has been remanded in another case, reference of which has been made in paragraph 3 of the petition.
It has further been submitted that the petitioner was assaulted by the police force and was framed in the present case. The injuries suffered by him tell it all.
The petitioner is in custody since 21.03.2018. Regard being had to the aforesaid facts and the period of custody of the petitioner above named, he is directed to be released on bail on his furnishing bail-bond in the sum of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, West, Muzaffarpur in connection with Kanti P.S. Case No. 129 of 2018.
