====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 02-04-2019 Heard learned counsel for the petitioner and the State.
The petitioner seeks bail in Ghorasahan P.S. Case No. 163 of 2017, instituted for the offence under Section(s) 302, 201 and 120(B) of the Indian Penal Code. Counsel for the petitioner submits that petitioner is in custody since 22.4.2017 having clean antecedent. The informant has levelled allegation against the petitioner merely on suspicion.
In the written report it is alleged that son of the informant namely, Rohit Kumar had gone to Nimoiya with his sister. On 9.4.2017, petitioner called the son of the informant namely, Rohit Kumar (since deceased) and went to Badharwa.

Thereafter, the dead body of son of the informant was found near Nahar in village Dhadhua. The allegation against the petitioner is that he has murdered the son of the informant. Counsel for the petitioner submits that petitioner has clean antecedent. The date of occurrence is 9.4.2017 and First Information Report has been lodged on 11.4.2017 i.e. after delay of two days. He further submits that informant is not eye witness of the occurrence.
Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 13th Additional Sessions Judge, East Champaran at Motihari, in connection with Ghorasahan P.S. Case No. 163 of 2017, subject to the condition that both the bailors will be the close relatives of the petitioner.
