The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 366 and 366A of the Indian Penal Code.

The accusation is of kidnapping the minor daughter of the informant. In 164 Cr. P.C. statement the victim has stated that she was kidnapped by the petitioner and two others and after three days she was released.

It is submitted by learned counsel for the petitioner that petitioner and victim has already performed marriage and they have shown affidavit to that effect, the same has been brought on record by way annexure-2 to the supplementary affidavit.

Patna High Court Cr.Misc. No.26363 of 2015 (2) dt.23-07-2015 2/2 The aforesaid facts constitute good ground for consideration of prayer for regular bail.

Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Motipur P.S. Case No.413 of 2014, pending before the learned Sub-Divisional Judicial Magistrate (West), Muzaffarpur.

With the above observation, this application is, accordingly, disposed off.
