JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 01-04-2015 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners seeks anticipatory bail in connection with Kudhni P.S. Case No. 262 of 2014 registered for the offences punishable under sections 441, 341, 342, 323, 307 and 504 read with 34 of the Indian Penal Code.

It has been contended that apart from section 307 of the Indian Penal Code, all other sections are bailable in nature and the ingredients of the offence punishable under section 307 of the Indian Penal Code are not attracted in the facts and circumstances of the present case.

Patna High Court Cr.Misc. No.36128 of 2014 (2) dt.01-04-2015 2/2 Learned counsel for the State has opposed the prayer for anticipatory bail.

Be that as it may, regard being had to the facts and circumstances of the case, in the event of arrest or surrender in the court below within four weeks from today, all the five petitioners, namely, (1) Anjala Jha @ Anjila Devi, (2) Satya Narayan Jha, (3) Swaraj Kumar Jha @ Swaraj Jha, (4) Naresh Kumar Jha @ Naresh Jha and (5) Amrendra Kumar Jha @ Sintu Kumar Jha @ Sintu Jha are directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, (West) Muzaffarpur in connection with Kudhani P.S. Case No. 262 of 2014, subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
