The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 307, 323, 325, 341, 342, 504/34 of the Indian Penal Code. The accusation is of assaulting the informant on protest being made for being abused and was thrown in a pond. Subsequently on alarm being raised, the informant was taken out of the pond and was taken to the hospital. It is submitted by learned counsel for the petitioners that in the background of pending Title Suit No. 362 of 2012 the accusation has been levelled. Though the injury has been stated to be grievous but the same has been issued by the Primary Health Centre. There is counter version of the
Patna High Court Cr.Misc. No.31523 of 2015 (2) dt.05-08-2015 2/2 occurrence also.
The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioners surrender within a period of six weeks in connection with Kasba P.S. Case No. 63 of 2015, pending in the Court of learned Additional Chief Judicial Magistrate, Purnea. Accordingly the application is disposed off.
