The petitioner apprehends his arrest in Rafiganj P.S. Case No. 39/2016, registered for the offences punishable under Sections 409, 188 and 34 of the Indian Penal Code. The petitioner is alleged to have not submitted the folders and register of appointment of Panchayat teachers and that is why this case has been lodged.

It is submitted that the petitioner is Panchayat Sachiv of Bour Panchayat falling in the block of Rafiganj. He was posted in the said panchayat on 15.07.2013. The appointment of panchayat teachers was made in the year 2006. Dayanand Kumar was the then Panchayat Sachiv. The predecessor did not hand over any folder or register related with appointment of panchayat teachers

Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad in connection with Rafiganj P.S. Case No. 39/2016, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Prabhat Kumar Jha, J.) Vinita/- U T
