Petitioner seeks bail in a case registered for the offence punishable under Section 7 of Essential Commodities Act, 1955.
Main allegation is against co-accused-Nitish Kumar that he was found in possession of K.Oil in huge quantity which was meant for distribution amongst B.P.L. people. Nitish Kumar disclosed that the petitioner is his copartner. Petitioner is in custody since 23.05.2018 after remand from some other case.
Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two
Patna High Court Cr.Misc. No.41802 of 2018 (2) dt.16-07-2018 2/2 sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Chandi Police Station Case No.97 of 2018, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
