2. The petitioner, who is in custody since 13.05.2017, has renewed his prayer for bail in connection with Maheshi (Jalai) P.S. Case No. 62 of 2017 having earlier been rejected by order dated 20.09.2017 in Criminal Miscellaneous No. 36320 of 2017.

3. It is submitted that while the earlier bail petition was rejected, however, liberty was granted to the petitioner to renew his prayer for bail after framing of charge which has since been done by order dated 06.10.2017 (Annexure-3).

4. Be that as it may, having regard to the entirety of the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of like amount each to the satisfaction of learned S.D.J.M., Saharsa, in connection with Maheshi (Jalai) P.S. Case No. 62 of 2017, on the following conditions:- (i) That one of the bailors shall be a close relative of the petitioner.

(ii) That the petitioner shall not indulge in any similar offence till conclusion of the trial.

No.53673 of 2017 (2) dt.07-02-2018 2/2 (iii) That the petitioner shall remain physically present in court on each and every date during trial and in the event of failure on two consecutive dates without sufficient reason, his bail bond shall be liable to be cancelled by the learned Court concerned.
