====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 10-07-2018 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

The petitioner is in custody since 30.05.2018 in connection with Basantpur P.S. Case No. 55 of 2017, registered for the offence punishable under Sections 272, 273, 308, 420 of the Indian Penal code and Sections 30, 40 (1) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. Learned counsel for the petitioner further submits that nothing was recovered from the conscious possession of the petitioner. Name of the petitioner surfaced on confessional statement of the co-accused Dinesh Rai and the said Dinesh Rai has been granted bail by coordinate Bench of this Court in Cr. Misc. No. 56459 of 2017

Patna High Court Cr.Misc. No.40951 of 2018(2) dt.10-07-2018 2/2 vide order dated 04.12.2017.

Considering the fact that the petitioner has no criminal antecedent and co-accused of this case has been granted bail by co-ordinate Bench of this Court, let the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Learned Additional District & Sessions -II-cum-Special Judge (Excise Act), Siwan in connection with Basantpur P.S.
