JUSTICE SATYAVRAT VERMA ORAL ORDER 22-04-2022 Heard learned counsel for the petitioner and learned APP for the State through video conferencing. The petitioner seeks bail in a case registered for the offences punishable under Sections 30(a), 30, 36, 38 and 41(i) of the Excise Act.

The learned counsel for the petitioner submits that the petitioner is in custody since 23.01.2022, he is a person with clean antecedent and charge-sheet has been submitted in this case.

Allegation is of recovery of 325 litre of liquor near the house of the named accused persons.

It is submitted that the petitioner was not arrested from the spot and his name came based on secret information.

Patna High Court CR. MISC. No.17443 of 2022(3) dt.22-04-2022 2/2 Learned A.P.P. opposes the bail application.

Considering the fact that the petitioner is in custody, he is a person with clean antecedent, charge-sheet has been submitted in this case and was not arrested from the spot, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 1,000/- (Rupees One Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Marhowrah P. S. Case No.633 of 2021. The application stands allowed.
