2. The petitioners seek bail in connection with Manihari P.S. Case No. 207 of 2023 registered for the offence punishable under Sections 341, 323, 324, 307, 302, 504, 506/34 of the Indian Penal Code.

3. Md. Abdus Salam @ Lal was caught hold by two Babars and has been killed by Md. Ansar. The petitioners are the member of unlawful assembly and there is no allegation of assault against them. The occurrence has taken place on the head of the moment. The petitioners are in custody since 15.09.2023.

4. Learned APP appearing for the State and learned counsel for the informant have opposed the prayer for regular bail of the petitioners.

5. Considering the aforesaid facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioners, above named, be released on bail after framing of charge if charge has not already been framed, on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM, Kaithar in connection with Manihari P.S. Case No. 207 of 2023.
