Petitioner is in custody in connection with Mokama P.S. Case No. 130 of 2018 for the offence under section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that in the instant case total 24 liters of Masaledar wine was recovered from the bag of the petitioner near Mokama station. Learned counsel submits that the bag does not belong to this petitioner. He was arrested in the instant case only on suspicion. Learned counsel for the petitioner submits that petitioner is in custody since 25.7.2018.

Considering the aforesaid, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs.

Patna High Court Cr.Misc. No.39962 of 2018(2) dt.10-07-2018 2/2 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Special Judge Excise, Patna, in connection with Special Case No. 4931 of 2018 arising out of Mokama P.S. Case No. 130 of 2018.
