On the last occasion also, the prayer of the learned counsel for the petitioner had been accepted to 'pass over' the case, as such this application was directed to be listed today and it was made clear in order dated 20.01.2017 that if no one appears, the case will be decided on its own merit.

The petitioner has challenged order dated 16.08.2010/21.12.2010 passed by Sri S.K. Mishra, learned Magistrate Ist class, Sikarahna, East Champaran passed in Chiraiya (Shikarganj) P.S.Case No.72 of 2001 for the offence under Sections 307, 324, 34 of the Indian Penal Code and Section 27 of the Arms Act as well as prayed for quashing the entire prosecution against him.

Heard learned A.P.P. also.
