JUSTICE DINESH KUMAR SINGH ORAL ORDER 23-05-2016 Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 324, 307, 504 of the Indian Penal Code and Section 27 of the Arms Act.

The prosecution case is that in the background of a dispute with regard to pathway four accused persons including the petitioners came variously armed when on the order of co-accused Ram Naresh Singh co-accused Ramesh Singh fired with his riffle causing injury to the driver of the Bolero vehicle Ritesh Kumar. When the informant made protest then co-accused Kamta Singh fired with riffle causing injury on the leg of the informant. Thereafter all the accused persons made indiscriminate firing.

It is submitted by learned counsel for the petitioners that specific accusation of firing is against coaccused Ramesh Singh and Kamta Singh. It is further

Patna High Court Cr.Misc. No.22837 of 2016 (2) dt.23-05-2016 2/2 submitted that petitioner No. 2 has no criminal antecedent whereas petitioner No. 1 is involved in three other cases but he is on bail in those cases.

Considering the criminal antecedent of the petitioner No. 1 Ram Bachan Singh, let learned Court below consider the prayer for regular bail of petitioner No. 1 Ram Bachan Singh, if he surrenders within a period of six weeks in connection with Bikramganj P.S. Case No. 12 of 2016, pending in the Court of learned Additional Chief Judicial Magistrate, Bikramganj.

So far as petitioner No. 2 Ravi Ranjan Kumar @ Ravi Kumar is concerned, let the petitioner No. 2 Ravi Ranjan Kumar @ Ravi Kumar, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Bikramganj in connection with Bikramganj P.S. Case No. 12 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
