The petitioner seeks bail in connection with Motihari P.S. Case No. 572 of 2017 registered for the offence punishable under Sections 387 and 120(B) of the Indian Penal Code.

Informant is the Director of Coaching Institute ,who in his written report had alleged that he had received several calls on mobile by which ransom of Rs. 10 Lacs was being demanded by the accused. The FIR is against unknown and thereafter he received two SMS message threatening him of dire consequence, if ransom is not paid. The mobile number does not belong to the petitioner. The name of the petitioner has surfaced

Patna High Court Cr.Misc. No.59857 of 2017(3) dt.15-01-2018 2/2 on the basis of confessional statement of co-accused Atul Kashyap. There is no incriminating material against the petitioner. Nothing has been recovered from his conscious possession. The petitioner has got no criminal antecedent and is in custody since 12.09.2017.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran at Motihari in connection with Motihari Town P.S.
