1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 364, 366(A) and 120(B)/34 of the Indian Penal Code.

3. Learned counsel for the petitioner submits that petitioner is a person with clean antecedent. It is further submitted that petitioner instituted Gaighat P.S. Case No. 04 of 2022 with an allegation that his daughter was kidnapped by Lalu Kumar Yadav and Biraju Kumar Yadav. It is next submitted that after institution of Gaighat P.S. Case No. 04 of 2022, the police started investigation and the daughter of the petitioner was recovered and her statement was recorded under Section 164 Cr.P.C. wherein she stated that on 03.01.2022 while she was going to the college from her house when on the way she was

Patna High Court CR. MISC. No.16709 of 2025(2) dt.16-04-2025 2/3 abducted by Lalu Kumar Yadav and Biraju Kumar Yadav with an intention to sell her in Nepal. It is also submitted that after the petitioner instituted Gaighat P.S. Case No. 04 of 2022, the wife of Biraju Kumar Yadav instituted Complaint Case No. 86 of 2022 alleging that her husband was kidnapped by the petitioner and others. It is submitted that Complaint Case No. 86 of 2022 was sent to the police station and, accordingly, Minapur P.S. Case No. 150 of 2022 was instituted. It is further submitted that husband of the informant i.e. Biraju Kumar Yadav came back home and thereafter his statement was recorded under Section 164 Cr.P.C. wherein he supported the case of the prosecution that he was kidnapped by the accused persons.

It is next submitted that Biraju Kumar Yadav was not recovered by the police rather he came back on his own which amply demonstrates that his wife had instituted the aforesaid case only with a view to coerce the petitioner into submission as he had earlier instituted Gaighat P.S. Case No. 04 of 2022 alleging that his daughter was abducted by the husband of the present informant along with others. It is also submitted that petitioner will not abscond rather will cooperate in the investigation to establish his innocence.

4. Learned A.P.P. for the State opposes the prayer for

Patna High Court CR. MISC. No.16709 of 2025(2) dt.16-04-2025 3/3 anticipatory bail of the petitioner.

5. Considering the submissions made by the learned counsel for the petitioner, let the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/Successor Court in connection with Minapur P.S. Case No. 150 of 2022, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
