The petitioner seeks bail in Rail Bhagalpur P.S. Case No. 132 of 2017 registered under Section 379 and 411 of the Indian Penal Code.
The petitioner is said to have pick-pocketed the money of the informant in running train and was apprehended on chase and the aforesaid money along with a piece of blade was recovered from his possession.
It is submitted by learned counsel for the petitioner that no such occurrence as alleged has took place. He happens to be a poor labourer and was proceeding to Bhagalpur to manage work and on the way there was commotion and during the said commotion someone had put some article in his pocket and in the
Patna High Court Cr.Misc. No.51578 of 2017 (03) dt.21-12-2017 - 2 - meantime police arrived there and recovered and seized the same from his possession. Moreover, the said money was handed over to the informant without conducting any T.I.P. of the said money. He has no criminal antecedent. The petitioner has been languishing in custody since 09.07.2017.
In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate (Railway), Bhagalpur in connection with Rail Bhagalpur (GRPS) P.S. Case No.132 of 2017.
