JUSTICE ASHUTOSH KUMAR ORAL ORDER 11-06-2020 The petitioners seek bail in anticipation of their arrest in connection with Nanpur P. S. Case No. 13 of 2020 dated 16.01.2020 instituted for the offences under Sections 30, 30(a), 38(i)(ii) and 41 of the Bihar Prohibition and Excise Act, 2016.

It appears that a pick-up van was intercepted from where 1591.506 litres of liquor was recovered. Some of the persons managed to run away from the aforesaid pick-up van. The petitioner is said to be one of them. It has been submitted on behalf of the petitioner that he has falsely been named in this case. Nobody has

Patna High Court CR. MISC. No.14897 of 2020(2) dt.11-06-2020 2/2 seen the petitioner running away as it is stated in the F.I.R. that taking advantage of the darkness, miscreants managed to run away from the place of recovery.

The petitioner has clean antecedents.

Considering the afore-stated facts, the petitioners, above-named, are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of six weeks from the date of receipt / production of a copy of this order, on their furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned ADJ II-cum-Special Judge, Excise Act, Sitamarhi in connection with Nanpur P. S. Case No. 13 of 2020, subject to the conditions as laid down under Section 438 (2) Cr.P.C.
