Heard both sides.
The petitioners apprehend their arrest in connection with Sahodara P.S. Case No.14 of 2018 registered under Sections 379, 420/34 of the Indian Penal Code, Section 33(b) of Indian Forest Act, Sections 4, 40 of Bihar Minor Mineral Concession Rules, 1972 and under Sections 3(a) of Conservation of Forest Act, 1980.
The informant alleged that he got information from
Patna High Court Cr.Misc. No.40023 of 2018 (2) dt.11-07-2018 2/2 the reliable sources that the petitioners being Contractor and his Munshi with the help of others carried stones from the river and laid stones on the road in the night itself.
Learned counsel for the petitioners submits that there is no witness to this effect that the petitioners took out stones from the river and spread the same on the road. On mere suspicion, the petitioners have been implicated in this case. Taking into consideration the aforesaid fact and the fact that the informant got information from reliable sources but the name of the sources has not been disclosed, the petitioners, above named, in the event of arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Bettiah, in connection with Sahodara P.S. Case No.14/2018, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
