JUSTICE ARUN KUMAR ORAL ORDER 25-01-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Sadar PS Case No. 421 of 2017 registered under Sections 143, 144, 158, 290, 414, 242, 273 of the IPC Sections 25(1-b)A/25-1A/25-1AA/26/26(ii), 35, 27 of the Arms Act and Section 309a) of Bihar Prohibition and Excise Act.
The allegation in brief is that a birthday party was organized in the house of Surendra Rai, liquor was being served to invitees and firing was also made. The police reached there and recovered some bottles of foreign liquor, country made pistols and other arms from each one of the apprehended accused.
Learned Counsel for the petitioner submits that the petitioner is a Group D Railway employee and there is no recovery of any liquor from his possession. It is alleged that only one country made pistol and a live cartridge was recovered from his possession. Similarly situated other co-accused have been admitted to bail and the petitioner has clean antecedent.
Having considered the said facts and circumstances, the petitioner, namely, Kundan Kumar is directed to be released on bail
Patna High Court Cr.Misc. No.51910 of 2017 (4) dt.25-01-2018 on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Special Judge, Excise Act, Muzaffarpur in connection with Sadar PS Case No. 421 of 2017.
