Let the defect(s), if any, be removed within a period of four weeks from today.

The petitioner seeks bail in connection with Belaganj P.S. Case No. 780 of 2022 registered for the offence under Section 30(a)(c)(d)(g) of the Bihar Prohibition and Excise Amendment Act, 2018.

Learned counsel for the petitioner submits that the petitioner is in custody since 17.01.2023 and there is a recovery of 800 liters of Jawa mahua which was destroyed on the spot keeping 2 liters as sample and 1200 litres Jawa mahua which was destroyed on the spot keeping 4 litres as sample.

Patna High Court CR. MISC. No.17019 of 2023(2) dt.10-05-2023 2/2 Learned A.P.P. has vehemently opposed the prayer for bail.

Considering the period of custody and the recovery of liquor, this application for regular bail is allowed. Let the petitioner, above named, be released on bail after completing one year in custody, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-cum-Exclusive Special, Excise court No.2, Gaya in connection with Belaganj P.S. Case No. 780 of 2022. The petitioner will visit concerned Police Station on the first Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.
