JUSTICE SUDHIR SINGH ORAL ORDER 22-09-2015 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in a case instituted under Sections 147, 148, 149, 323, 307.504 of the Indian Penal Code and 27 of the Arms Act.

Allegation against the petitioners is that they assaulted the informant and his nephew.

It has been submitted on behalf of the petitioners that petitioners were on police bail during the pendency of investigation. Subsequently, chargesheet was also submitted for bailable offence but the court below differing with the same has taken cognizance for non-bailable offence.

Accordingly, the present application is disposed of in

Patna High Court Cr.Misc. No.26154 of 2015 (3) dt.22-09-2015 2 / 2 the light of the judgment dated 12.4.2004 passed in the case of Mahendra Pd. Singh vs. State of Bihar reported in 2004(3) PLJR 491.
