JUSTICE DINESH KUMAR SINGH ORAL ORDER 30-05-2016 Petitioner is apprehending his arrest in a case registered for the offences punishable under Section 394 of the Indian Penal Code.

The prosecution case is that the informant was robbed his mobile, laptop cash of Rs. 20,000/- and other articles leading to registration of the F.I.R against unknown. The name of the petitioner sprang up during investigation when it was found that petitioner used his sim card in the robbed mobile of the informant.

It is submitted by learned counsel for the petitioner that only on suspicion the accusation has been levelled against the petitioner.

A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. The aforesaid facts constitute ground for

Patna High Court Cr.Misc. No.23990 of 2016 (2) dt.30-05-2016 2/2 consideration of prayer for regular bail, if the petitioner surrenders within a period of six weeks in connection with Runnisaidpur P.S. Case No. 511 of 2013, pending in the Court of learned Chief Judicial Magistrate, Sitamarhi. With the observations above, the application stands disposed off.
