KUMAR ORAL ORDER 18-10-2017 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in Bihta P.S.Case No.317 of 2017 instituted for the offence under Section 302/34 of the Indian Penal Code.

Informant is the father of the deceased who has stated in the F.I.R. that on 13.05.2017 his son deceased Dinesh Kumar accompanied Sanjay Kumar, Mahesh Singh and Praveen Kumar on motor cycle to attend the marriage ceremony of cousin brother of co-accused Sanjay Kumar and on the next day morning he received telephonic message that his son had been killed and thrown near Shamiyana. The informant has not named any person rather he has stated that some unknown miscreants might have killed his son.

No.49181 of 2017 (2) dt.18-10-2017 2/2 It has been submitted that name of the petitioner has subsequently surfaced on the basis of the confessional statement of co-accused Ranjit Singh. Except that no material has come against the petitioner. There cannot be any motive of the petitioner to kill Dinesh Kumar. He has no criminal antecedent.

Considering the facts and circumstances of the case, let the petitioner , above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of A.C.J.M., Danapur, Patna in Bihta P.S.Case No.317 of 2017.
