JUSTICE ASHUTOSH KUMAR ORAL ORDER 10-07-2018 The petitioner seeks bail in connection with Raniganj P.S. Case No. 349 of 2017 dated 23.09.2017 instituted for the offence under Section 392 of the Indian Penal Code. Three unknown miscreants are alleged to have taken away the motorcycle of the informant and his personal belongings as well. Later, the petitioner was found to be in possession of the aforesaid motorcycle. For the aforesaid recovery, a separate case under Section 414 of the Indian Penal Code was also registered against him. In the aforesaid case, the petitioner has been granted bail.

The learned counsel for the petitioner has submitted that the present prosecution of the petitioner is with respect to the same cause of action and he is in custody since

Regard being had to the aforesaid facts, the petitioner above named, is directed to be released on bail on his furnishing bail bonds of Rs. 10,000/-(ten thousands) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Araria in connection with Raniganj P.S.
