The petitioner is accused in Khizar Sarai Police Station Case No 26 of 2016 registered for the offences punishable under Sections 302, 201/34 of Indian Penal Code. Counsel for the petitioner submits that the petitioner has been implicated in this case only on the basis of suspicion. The first information report is against unknown persons. It is submitted that during course of investigation, it has come that the victim, while delivering the invitation card, met with an accident with one person who was riding on a motorcycle. Petitioner happens to be father of the said person who was driving the motorcycle. Counsel for the petitioner submits that the petitioner has no connection with the allegation whatsoever and he is in

Patna High Court Cr.Misc. No.55456 of 2017 (3) dt.12-12-2017 2/2 custody since 24.08.2017 and the investigation in the case is complete. It is further submitted that the petitioner has no criminal antecedent.

Considering the aforesaid submission, prayer for bail is allowed. Let the petitioner above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate VII, Gaya in Khizar Sarai Police Station Case No 26 of 2016 subject to the following conditions :

(i) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.

(ii) That the petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
