Learned counsel for the petitioners is expected to honour his undertaking given in the instant case for depositing the requisite court fee and to remove the defects as pointed out by the office when called upon to do so by the office.

The petitioners are apprehending their arrest in a case registered for the offences punishable under

Patna High Court CR. MISC. No.27369 of 2021(2) dt.18-11-2021 2/3 Sections 341, 323, 324, 379, 308, 504, 506/34 of the Indian Penal Code.

Learned counsel for the petitioners submits that petitioner Nos. 1 and 2 namely Mahendra Rai and Yogendra Rai have been arrested. Hence, he seeks permission to withdraw the petitions with regard to petitioner Nos. 1 and 2.

Permission is accorded.

Accordingly, the petitions with regard to petitioner Nos. 1 and 2 are permitted to be withdrawn. It is alleged that petitioners and others armed with lathi, danda, farsa and iron rod came at the door of the informant and abused and attacked on the informant and his family members. They also snatched gold ornaments and cash.

It is submitted by learned counsel for the petitioners that there is general and omnibus allegation against the petitioners. The injuries have been found to be simple in nature. A statement has been made in para

In the facts and circumstance of the case, let the petitioners, above named, except petitioner Nos. 1 and 2, in the event of their arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-III-cum-Sub Judge, West, Muzaffarpur in connection with Paroo P.S. Case No. 186 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
