The petitioners apprehend their arrest in a case registered for the offence under Section 307 & other allied sections of the Indian Penal Code and Section 3 / 4 of Damage of Public Property Act.

As per the prosecution case, these petitioners alongwith other co-accused persons abused and assaulted one constable and the informant, as a result of which, both of them sustained injury. The accused persons are also alleged to have ransacked the furniture of the office.

It is submitted on behalf of petitioners that allegation

Patna High Court CR. MISC. No.17293 of 2022(2) dt.27-09-2022 2/2 is general and omnibus. No specific overt act has been alleged against these petitioners. As a matter of fact, the informant misbehaved and abused local people and in retaliation, the public, assembled there, became aggressive and thereafter, the informant started lathi charge on them, in which, some of the persons sustained injury.

Learned A.P.P. for the State has opposed the prayer for bail of petitioners.

Considering the aforesaid facts and circumstances, in the event of their arrest/surrender within a period of six weeks from today, let the above-named petitioners be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Supaul in connection with Supaul P.S. Case No. 458 of 2019, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
